If you do not agree to these Terms, you may not access or use the Service. We reserve the right to update these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

Biteyy is a restaurant discovery and food tracking application that provides:

• Restaurant recommendations based on your preferences
• Location-based restaurant search
• Food diary with nutritional analysis
• Restaurant information, ratings, and directions
• Premium subscription features for enhanced functionality

The Service relies on third-party data sources and location services. While we strive for accuracy, we do not guarantee that all information will be accurate, complete, or up-to-date.

3. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you represent that you have your parent's or guardian's permission to use the Service. By using the Service, you represent and warrant that you meet these eligibility requirements.

5. Subscriptions and Payments

Subscription Plans

Biteyy offers free and premium subscription tiers. Premium subscriptions provide access to enhanced features including unlimited recommendations, advanced food diary features, and priority support.

Billing

Subscriptions are billed through your device's app store (Apple App Store or Google Play Store). By purchasing a subscription, you agree to pay the fees associated with your chosen plan. Subscriptions automatically renew unless canceled before the renewal date.

Refunds

Refund policies are governed by the app store through which you purchased your subscription (Apple or Google). Please refer to their respective refund policies. We do not directly process refunds for app store purchases.

Changes to Pricing

We reserve the right to modify subscription pricing at any time. Price changes will not affect your current subscription period but will apply upon renewal. You will be notified of price changes in advance.

6. Usage Limits and Fair Use

To ensure fair access and prevent abuse, we implement usage limits:

• Free users: Limited number of recommendations per day
• Premium users: Unlimited reasonable use of features
• All users: Restrictions on automated access, scraping, or API abuse

We reserve the right to enforce these limits and take action against accounts that engage in excessive or abusive use that impacts service quality for other users.

7. User Conduct and Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Violate the rights of others, including privacy and intellectual property rights
• Upload content that is harmful, offensive, defamatory, or inappropriate
• Attempt to gain unauthorized access to the Service or other users' accounts
• Interfere with or disrupt the Service or servers
• Use automated scripts, bots, or scrapers to access the Service
• Reverse engineer, decompile, or disassemble any portion of the Service

By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, process, and display your content solely to provide and improve the Service.

You are solely responsible for your User Content. You represent and warrant that you own or have the necessary rights to submit your content and that it does not violate any third-party rights or applicable laws.

Content Removal

We reserve the right to remove any User Content that violates these Terms or that we deem inappropriate, without prior notice.

The Service integrates with and relies on third-party services including:

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

No Guarantee of Accuracy

We do not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free
• Restaurant information, ratings, or recommendations will be accurate or reliable
• Nutritional information will be accurate or suitable for medical purposes
• Any defects or errors will be corrected
• The Service will meet your specific requirements

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BITEYY, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content
• Errors or inaccuracies in restaurant information or recommendations
• Any health consequences resulting from reliance on nutritional information

IN NO EVENT SHALL BITEYY'S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO BITEYY IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for consequential or incidental damages. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.

13. Indemnification

You agree to indemnify, defend, and hold harmless Biteyy, its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms
• Your use or misuse of the Service
• Your User Content
• Your violation of any rights of another party
• Your violation of any applicable laws or regulations

14. Changes to the Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice, for any reason. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

We may also impose limits on certain features or restrict your access to parts or all of the Service without notice or liability.

17. Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Biteyy operates, without regard to its conflict of law provisions.

Informal Resolution

Before filing a claim, you agree to try to resolve the dispute informally by contacting us at codeboi98@gmail.com. We will attempt to resolve the dispute through good faith negotiations.

Arbitration

If we cannot resolve a dispute informally, any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration, except that either party may seek injunctive or other equitable relief in court to prevent the actual or threatened infringement, misappropriation, or violation of a party's intellectual property rights.

Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive your right to participate in a class action lawsuit or class-wide arbitration.

18. Geographic Restrictions

The Service is controlled and operated from our facilities. We make no representations that the Service is appropriate or available for use in all locations. Access to the Service from jurisdictions where its contents are illegal or restricted is prohibited.

19. Export Control

You agree to comply with all applicable export and import laws and regulations. You represent that you are not located in a country subject to a government embargo or designated as a "terrorist supporting" country, and that you are not on any government list of prohibited or restricted parties.

These Terms, together with our Privacy Policy and any other legal notices or agreements published by us on the Service, constitute the entire agreement between you and Biteyy regarding the Service and supersede all prior agreements and understandings.

21. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect and enforceable.

22. Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. The waiver of any such right or provision will be effective only if in writing and signed by an authorized representative of Biteyy.

23. Assignment

You may not assign or transfer these Terms or your rights hereunder, in whole or in part, without our prior written consent. We may assign these Terms at any time without notice.
